This website is owned and operated by Babbabing. These Terms set forth the terms and conditions under which you may use our website and services as offered by us. This website offers visitors Fine Art and Digital printing. By accessing or using the website of our service, you approve that you have read, understood, and agree to be bound by these Terms

These Terms tell you how we will provide goods and services to you, what to do if there is a problem and other important information.

The placing of an order with Babbabing expresses acceptance of our terms and conditions. We reserve the right to change or amend these terms and conditions without notice.

 

Placing an Order

We only accept written instruction from the client to carry out services. This may be by electronic means such as email or our online order form.

Our order process allows you to check and amend any errors before submitting your order to us. Please check the order carefully before confirming.

Babbabing will not be responsible for errors which occur in the absence of written instructions or in the case of ambiguous and unclear instructions. Complaints must be notified within four days of receipt of work.

Our acceptance of your order takes place when we receive payment, at which point the Contract between you and us will come into existence

 

We will make every effort to ensure orders are completed within the stated times, but will not accept any liability for damages in the event of failure to do so.

If for any reason, we have a delay in receiving stock from a supplier we will contact you

within two-working days to advise of a possible delayed delivery date or to offer an

alternative solution.

 

Images
It is the responsibility of all customers to ensure that all material placed with Babbabing is free from any copyright claims and to indemnify us against all costs claims and demands arising in respect of verification of copyright authority or any alleged breach of copyright by Babbabing.

 

No materials or data deposited with Babbabing shall contain any material which is defamatory, racist, libellous or obscene. We reserve the right to refuse such images and to inform the police.

 

The Images are stored in multiple geographical locations to ensure security and availability of the images. However, Babbabing is not a storage facility for your Images and you must ensure that you have your own storage and back up.

 

We cannot guarantee the final outcome of a print if the artwork you supply is of inferior quality or not suitable for a print size required by you. Please refer to our Upload requirements.

 

Babbabing reserves the right to dispose of digital data files after printing, unless agreed otherwise with the Client in writing.

 

Any items, including original artwork, deposited with Babbabing by the Client or produced by us for the Client are not collected within 12 months of completion then Babbabing reserves the right to dispose of, sell, or destroy such items.

 

Babbabing retains the copyright of any artwork or design, including digital capture, created by it’s agents.

We will only use any images for the promotion of our own products and services. We will not sell or distribute any right(s) to any third parties.

 

Print Size Tolernces and Colour Matching

Sizes quoted are approximate only and on occasions can be fractionally over or under the size quoted. Whilst we take every effort to produce accurate sized prints, we are also working with natural cotton rag papers and canvases that can expand and contract with environmental factors such a humidity and temperature.

 

Due to the imprecise nature of colour management clients accept that colour matching is subjective, and exact colour matching can not be guaranteed. Screen proofs will predict design layout, text accuracy, image proportion and placement, but not colour or density. Babbabing will use its colour profiles to achieve the closest possible match within the limitations and constraints of available technologies, materials, and processes used. Please note that some colours may not accurately reproduce. Babbabing cannot be held responsible for differences in colour, tone, contrast and density between final supplied prints and scans and their appearance on screen or from the provided colour reference files or for the final colour appearance of laminated or coated works.

 

Defects

If a product has a defect we shall request a return of the product and, if we accept responsibility, we will offer to reprint the image and re-deliver at no additional cost or cancel the order and refund in full.

 

Terms of Payment
Payment is accepted using the following:
VISA or MasterCard on-line, cheque in person.
We operate on a cleared funds basis and will not process any orders for goods or services until funds are cleared. All print proofs or print orders must be paid in full before printing and dispatch.

Babbabing does not offer credit accounts.

Babbabing is not currently registered for VAT. 

 

 

Deliveries

Some deliveries may be delayed due to your location, accidents or local disruptions. In these instances Babbabing will not be liable for any consequential losses.

Ensure that you check your delivery before signing for it. We will not accept liability for missing or damaged items unless this is brought to the attention of the delivery company. Please do not sign for your goods until you have physically checked them and are satisfied that they are in perfect condition.

 

Should an item be returned due to failed delivery we will contact you for further instructions and may charge you for further delivery costs and storage. If, despite reasonable efforts, we are un-able to contact you or re-arrange delivery the Contract will be ended and all costs charged for.

 

If using our drop shipping service responsibility for any loss, damage or delay of items tare entirely at our clients liability; as if the client had provided the said services directly themselves. Where items that are lost or damaged in transit, the client shall be responsible for re-ordering and full payment of replacement items and associated re-delivery charges.

 

If you have asked to collect the goods from our premises you can collect them from us at any time during our working hours of 9am to 7pm on weekdays (excluding public holidays) by prior arrangement. It may be possible to arrange collection at the weekend if agreed.

 

Order Cancellation
Orders can be cancelled/amended prior to printing – please contact us as soon as possible to determine whether you are able to amend or cancel your order. If the Order is to be changed we will inform you of any changes to the price of the goods or lead time. Once the order has been printed it cannot be cancelled and will be dispatched as normal.

 

Liability

In the unlikely event of loss, theft or damage to a client’s goods or materials, whether caused by negligence or otherwise, liability is limited to the cost of replacement of the raw materials. No responsibility will be accepted for consequential losses and it shall be the responsibility of the customer/client to arrange adequate and appropriate insurance against the risk of any loss or damage.
